This Acceptable Use Policy sets out the rules that apply to all users of services provided by Motivation Digital Ltd (trading as Motivation) at motivation.digital. It supplements our Terms of Service and applies to all individual users, paid customers, partners, and visitors.
1. Purpose and scope
This policy exists to ensure that our platform, courses, and community remain safe, respectful, lawful, and useful for everyone. By using our services in any way — including reading, posting, downloading, integrating, or making payments — you agree to comply with this policy. Breach of this policy may result in suspension, content removal, account closure, or referral to law enforcement.
2. General use rules
You agree to:
- Provide accurate information when registering and keep it current
- Use the services only for lawful purposes and only in ways that do not infringe the rights of others
- Not share your account credentials or allow others to access content under your account
- Take reasonable steps to secure your account, including strong passwords and prompt revocation of compromised credentials
- Comply with all applicable laws, including export control, sanctions, and consumer protection law
3. Prohibited activities
You must not use our services to:
- Upload, share, or transmit content that is defamatory, harassing, discriminatory, obscene, threatening, or otherwise harmful
- Infringe any intellectual property right, including copyright, trademark, or trade-secret rights
- Engage in phishing, fraud, identity theft, or any deceptive activity
- Distribute malware, ransomware, viruses, or any malicious code
- Attempt to gain unauthorised access to our systems, accounts, or data — including probing, scanning, or testing the vulnerability of our infrastructure without prior written consent
- Scrape, harvest, mirror, or systematically extract content from our platform by any automated means
- Resell, sub-licence, or share access to our paid services without our written authorisation
- Use our services to send unsolicited bulk communications (spam) or to operate a messaging service that violates anti-spam law
- Impersonate another person, organisation, or our own staff or affiliates
- Engage in any activity that interferes with the proper operation of the platform or imposes an unreasonable load on our infrastructure
- Distribute, generate, or promote child sexual abuse material (CSAM), terrorist content, or any content that is illegal under applicable law
- Train AI models on our content or output without our express written permission
- Violate any applicable law, regulation, sanctions list, or third-party right
4. Content standards
Any content you submit through our services — including comments, forum posts, reviews, uploaded materials, or community contributions — must:
- Be accurate to the best of your knowledge and not misleading
- Comply with all applicable laws and regulations
- Not infringe any copyright, trademark, database right, moral right, or other intellectual property right
- Not promote violence, hatred, discrimination, or illegal activity
- Not contain material that is sexually explicit, gratuitously violent, or otherwise inappropriate for a general audience
- Be respectful of other users, our team, and third parties referenced in the content
5. Community and forum conduct
Our community spaces — course discussions, forums, group calls, and chat channels — are for constructive learning and peer support. When participating you agree to:
- Engage respectfully, even when you disagree
- Stay broadly on topic for the channel or thread
- Refrain from promoting unrelated products, services, or affiliate links without permission
- Respect confidentiality — do not share private conversations, personal stories, or member contact details outside the community without consent
- Not give regulated advice (medical, legal, financial, or therapeutic) unless you are qualified to do so and clearly identify yourself
- Use the report function to flag content that violates this policy rather than escalating publicly
6. Artificial intelligence and automated content
You may use AI tools to help with your own learning, but content posted to our community spaces should reflect your own thinking and engagement. When using AI you agree to:
- Disclose AI involvement clearly when posting AI-generated material in community spaces
- Verify factual claims before posting them as your own — AI tools can produce confidently wrong information
- Not use AI to generate spam, deepfakes, impersonations of real people, or content designed to mislead
- Respect the intellectual property of others when using AI tools that process third-party content
You also agree not to use any feature of our services to train a competing AI model.
7. Reviews and ratings
If you submit a review or rating about our products, courses, or coaches, your review must:
- Reflect your genuine experience — we do not solicit, accept, or display fake or incentivised reviews
- Be honest, fair, and based on your actual interaction with the product or service
- Not contain false statements about us, our staff, or other users
- Not include personal information about others, including their names or contact details, without consent
- Not be used to extort, threaten, or coerce Motivation or its staff
We reserve the right to remove reviews that do not comply with this policy.
8. User contributions and intellectual property
By submitting any content, including discussion posts, uploads, suggestions, or feedback ("Contributions"), you confirm that you own or have permission to share that material and that it does not infringe any third-party rights. You retain ownership of your Contributions but grant Motivation a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and adapt them for the purpose of operating the services and improving them. Where you are giving feedback or suggestions, that licence is perpetual and irrevocable.
9. Reporting illegal content (DSA Article 16 notice-and-action)
If you believe content on our services is illegal under applicable EU, UK, or other law, please use our contact form and provide:
- A clear and substantiated explanation of why you consider the content illegal
- The exact electronic location of the content (URL or page reference) and any other information needed to identify it
- Your name and contact details (anonymous reports are accepted but limit our ability to follow up)
- A statement of good-faith belief that the information in the notice is accurate and complete
This procedure satisfies the requirements of Article 16 of the EU Digital Services Act (Regulation (EU) 2022/2065) and equivalent obligations under the UK Online Safety Act 2023. We acknowledge receipt of qualifying notices, act on them in a timely manner, and notify both the reporter and (where appropriate) the affected user of the outcome and the reasons for our decision.
Decisions to remove, restrict, or maintain content may be appealed by the affected user (see section 12).
10. Reporting copyright infringement (DMCA / equivalent)
If you are an intellectual-property rights-holder and believe content on our services infringes your copyright, please contact us with the information set out in section 15 of our Terms of Service (DMCA-compliant notice). Counter-notices may be submitted via the same channel. Repeated infringement may result in account termination.
11. Reporting other policy breaches
If you believe content or behaviour on our platform breaches this policy but is not illegal content or copyright infringement, please use our contact form and provide:
- The URL or location where the issue appears
- A description of the problem and which part of this policy you believe has been breached
- Your contact details so we can follow up if needed
- Any evidence you can provide (screenshots, links, dates)
We aim to acknowledge breach reports within two working days and to act on them within seven working days where action is appropriate.
12. Enforcement and consequences
We reserve the right to investigate suspected breaches of this policy. Where a breach is confirmed, the consequences may include any of the following, depending on severity:
- A formal warning
- Removal or editing of offending content
- Temporary suspension of account access
- Permanent termination of account, with no refund of fees already paid
- Recovery of any costs we incur as a result of the breach
- Reporting to law enforcement or regulatory authorities (including, where required by law, reporting CSAM to the Internet Watch Foundation, NCMEC, or equivalent national hotlines)
- Civil legal action where damages are caused
We will use reasonable judgment when applying these measures. We may give notice and an opportunity to remedy a breach before taking action where it is safe and lawful to do so; we may also act without prior notice in cases involving security risks, illegal content, or imminent harm.
13. Internal complaint-handling and appeals
If your content has been removed or your account suspended and you believe this was in error, you may appeal by contacting us. Provide the original content (or a description of it) and an explanation of why you believe the action was incorrect. We will review and respond within ten working days. This internal complaint-handling system meets the requirements of Article 20 of the EU Digital Services Act.
If you remain dissatisfied with the outcome, EU users may refer the dispute to a certified out-of-court dispute settlement body under DSA Article 21. UK users may refer matters to the relevant UK regulator (such as Ofcom for online-safety matters).
14. Trusted flaggers and statutory reporting
Where required by applicable law (DSA Article 22), notices submitted by entities awarded "trusted flagger" status by the EU Digital Services Coordinator of the relevant Member State will be processed with priority and without undue delay. Statutory reporting of suspected illegal content (CSAM, terrorist content) is made to the appropriate national authority in addition to any platform-level action.
